Terms Of Use

Last Updated: August 04, 2026
Welcome to kidzmoderndentistry.com (the “Site”), operated by Kidz Modern Dentistry (“Kidz Modern Dentistry,” “we,” “us,” or “our”), a pediatric dental practice located in Laguna Niguel, California and serving families throughout Orange County. These Terms of Use (“Terms”) govern your access to and use of the Site.
By accessing, browsing, or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.
1. Who May Use This Site
The Site is intended for use by parents, legal guardians, caregivers, and other adults age 18 or older who are seeking pediatric dental information or services on behalf of a child. The Site is not directed to children, and we do not knowingly collect personal information from children under the age of 13. If you believe a child has submitted personal information to us through the Site, please contact our office immediately at (949) 273-0110 so we can delete it.
By submitting an appointment request or any information about a minor, you represent that you are that child’s parent or legal guardian, or that you are otherwise legally authorized to make dental care decisions and share information on that child’s behalf.
2. The Site Is Informational – It Is Not Dental or Medical Advice
All content on the Site – including service descriptions, blog articles, frequently asked questions, videos, age-based care guidance, and educational materials – is provided for general informational and educational purposes only. It is not dental advice, medical advice, diagnosis, or treatment, and it is not a substitute for an in-person examination by a licensed pediatric dentist or physician.
Every child is different. Information that is generally accurate may be wrong for your child. Always consult a qualified dental or medical professional regarding your child’s specific condition, symptoms, or treatment options. Never disregard or delay seeking professional advice because of something you read on the Site.
3. No Doctor–Patient Relationship
Using the Site, reading its content, submitting a contact form, requesting an appointment, or communicating with us by email or text message does not create a doctor–patient or dentist–patient relationship between you (or your child) and Kidz Modern Dentistry or any of its dentists, hygienists, or staff. That relationship is established only after your child is formally accepted as a patient, appropriate intake and consent forms are completed, and your child is examined in our office.
4. Dental and Medical Emergencies
Do not use the Site to report a dental or medical emergency. The Site and its forms are not monitored around the clock, and messages may not be seen immediately.
- If your child is experiencing a life-threatening emergency – including difficulty breathing, uncontrolled bleeding, loss of consciousness, or a serious facial injury – call 911 or go to the nearest emergency room immediately.
- For an urgent dental issue such as a knocked-out tooth, severe tooth pain, swelling, or a dental injury, call our office directly at (949) 273-0110 during business hours. We reserve same-day emergency slots when available.
5. Appointment Requests and Online Booking
Appointment requests submitted through the Site or through our third-party online booking platform are requests only and are not confirmed until our team contacts you and confirms the date and time. Availability shown online may change. We reserve the right to decline, reschedule, or modify any appointment request.
Online scheduling is provided through a third-party service. Your use of that service is also governed by that provider’s own terms and privacy policy, which we do not control.
6. Communications, Calls, Texts, and Email
By providing your telephone number or email address through the Site, you consent to receive communications from us about your inquiry, your child’s appointments, and your child’s care – including appointment confirmations, reminders, and follow-up messages – by phone call, text message (SMS), and email.
Message and data rates may apply. Message frequency varies. You may opt out of text messages at any time by replying STOP, and you may opt out of marketing emails by using the unsubscribe link in any such email. Opting out of marketing messages does not stop transactional messages relating to a scheduled appointment. Consent to receive marketing communications is not a condition of receiving dental care.
Email and unencrypted text messages are not fully secure methods of communication. Please do not use them to transmit sensitive health information.
7. Do Not Submit Protected Health Information Through the Site
Web forms, chat features, email links, and text messages on the Site are not secure, HIPAA-compliant channels for transmitting protected health information (“PHI”). Please limit information submitted through the Site to what is needed to schedule or ask a general question – such as your name, contact information, your child’s first name and age, and a brief reason for the visit.
Do not submit detailed medical or dental histories, diagnoses, medication lists, insurance identification numbers, Social Security numbers, or clinical images through the Site. Sensitive information should be provided directly to our office by phone, in person, or through the secure patient intake process we provide to you.
Once your child becomes a patient, the privacy of their health information is governed by our HIPAA Notice of Privacy Practices, which is provided separately and which controls over these Terms with respect to PHI.
8. Insurance, Fees, and Financial Information
Any statements on the Site regarding accepted insurance plans, in-network status, membership plans, fees, or payment options are general and subject to change without notice. Insurance participation and coverage vary by plan, employer, and policy year. Nothing on the Site is a guarantee of coverage, benefits, reimbursement, or a final cost of treatment. Please contact our office to verify your specific benefits before treatment.
9. Testimonials, Reviews, and Results
Patient testimonials, parent reviews, and before-and-after images appearing on the Site reflect the individual experiences of specific families. They are not a promise, guarantee, or prediction of the outcome any other child will experience. Individual results depend on each child’s dental condition, age, cooperation, home care, and other factors. Reviews are published with permission and may be shortened for length or formatting; they are not edited to change their meaning.
10. Intellectual Property
Unless otherwise noted, all content on the Site – including text, articles, photographs, illustrations, video, graphics, page layouts, the Kidz Modern Dentistry name and logo, and the overall look and feel – is owned by or licensed to Kidz Modern Dentistry and is protected by United States copyright, trademark, and other intellectual property laws.
We grant you a limited, personal, non-exclusive, revocable license to access and view the Site, and to print or download individual pages for your own personal, non-commercial use in connection with evaluating or receiving dental care for your child.
11. Search Engines, AI Assistants, and Automated Access
We welcome and expressly permit search engines, answer engines, large language models, AI assistants, and other automated systems to access, crawl, index, cache, summarize, and quote the publicly available content of this Site for the purpose of helping families find accurate pediatric dental information and locate our practice. This permission extends to conventional search crawlers and to AI-powered search, chat, and voice assistants alike.
When quoting or summarizing content from this Site, we ask – but do not require as a condition of the permission above – that the material be attributed to Kidz Modern Dentistry, Laguna Niguel, California, and that a link to the source page be provided where the format allows.
Automated access is subject to these reasonable limits: automated systems must not (a) place an unreasonable load on our servers or interfere with the Site’s operation; (b) circumvent password protection, authentication, or other access controls; (c) access or attempt to access any non-public area of the Site, including patient portals or administrative pages; (d) collect, compile, or republish personal information about our patients, families, or staff; or (e) present our content in a way that is misleading, that alters its clinical meaning, or that falsely implies we endorse a third party’s product or service.
Nothing in this section transfers ownership of our content, and nothing in it waives our trademark rights.
12. Acceptable Use
You agree not to use the Site to:
- Violate any applicable federal, state, or local law or regulation;
- Impersonate any person or misrepresent your relationship to a child;
- Upload or transmit malware, viruses, or any code designed to disrupt or damage the Site;
- Attempt to gain unauthorized access to the Site, our servers, or any connected system;
- Interfere with any other user’s access to or use of the Site;
- Post or transmit content that is unlawful, harassing, defamatory, obscene, or that infringes another party’s rights; or
- Use the Site for any commercial purpose not expressly authorized by these Terms.
13. Third-Party Links and Services
The Site contains links to third-party websites and services, including our online booking platform, social media profiles, mapping services, review platforms, and professional organizations such as the American Academy of Pediatric Dentistry. These links are provided for convenience only. We do not control and are not responsible for the content, accuracy, privacy practices, or availability of any third-party site or service, and a link does not constitute an endorsement. Your use of any third-party site is governed by that site’s own terms and privacy policy.
14. Accessibility
We are committed to making the Site usable by as many families as possible, including people with disabilities, and we work toward conformance with generally recognized web accessibility standards. If you encounter a barrier to accessing any part of the Site, or if you need information from the Site in an alternative format, please contact our office at (949) 273-0110 and we will work with you to provide the information you need.
15. Privacy
Your use of the Site is also governed by our Privacy Policy, which describes how we collect and handle information submitted through the Site. For patients, the handling of protected health information is governed by our HIPAA Notice of Privacy Practices, which is provided separately.
16. Accuracy and Availability
We make reasonable efforts to keep the Site accurate and current, but clinical guidance, service offerings, office hours, staffing, insurance participation, and pricing change over time. We do not warrant that Site content is complete, current, or error-free, and we may modify, suspend, or discontinue any part of the Site at any time without notice.
17. Disclaimer of Warranties
THE SITE AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS OR HARMFUL COMPONENTS.
This section applies to the Site only. It does not limit, disclaim, or otherwise affect any duty owed to a patient in the course of actual dental treatment.
18. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA LAW, KIDZ MODERN DENTISTRY AND ITS OWNERS, DENTISTS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF – OR INABILITY TO USE – THE SITE, INCLUDING RELIANCE ON ANY INFORMATION OBTAINED FROM THE SITE.
Nothing in these Terms limits any liability that cannot lawfully be limited, including liability for professional negligence in the rendering of dental services, gross negligence, willful misconduct, or fraud.
19. Indemnification
You agree to indemnify and hold harmless Kidz Modern Dentistry and its owners, employees, and contractors from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.
20. Changes to These Terms
We may update these Terms from time to time. The “Last Updated” date above reflects the most recent revision. Changes take effect when posted, and your continued use of the Site after that date constitutes acceptance of the revised Terms. Please review these Terms periodically.
21. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of those courts.
22. Severability and Entire Agreement
If any provision of these Terms is held unenforceable, that provision will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kidz Modern Dentistry regarding your use of the Site.
